Those are the two key reasons why the U.S. Court of Appeals, reports WCVB, overturned the death penalty for Boston Marathon bomber Dzhakhar Tsarnaev. The trial just wasn't a fair one.
The Court ordered a new penalty phase trial. In 2015, the young man have been convicted on 30 counts and sentenced to death. The Court also threw out some of the convictions.
It seems a travesty of justice that it was overlooked that, for example, one juror had been posting on social media about the trial. Also, what was obvious, even to a first year law student, was that there should have been a change of venue - away from "the scene of the crime." Emotions on the Boston Metro area were still raw.
Tsarvaev is fortunate. Donald Trump had ordered the resumption of federal executions.
