That could mirror how the legal concept of public nuisance had been applied to traditional product liability litigation. Because of that, one-time manufacturer and marketer of lead paint - Sherwin-Williams - spent decades in state courts, defended by Jones Day. (Recently, in California, that didn't turn out so hot.)
The lawyers for Donald Trump assert in their 20-page letter to special counsel Robert Mueller is that the President of the United States has absolute power. Therefore, he should not have to testify in what is crudely known as "Russiagate." Here is a copy of that communication.
I also have been thinking along those lines: Dancing on the rim of legal theory. In Small Claims Court in Collin County, Texas I am toying filing a claim that a business in Plano, TX ought to pay me $272.00 for services they prevented me from rendering. This could be in addition to seeking help from the U.S. Congress. The integrity of the American brand of American capitalism is at stake.
Last week, I was scheduled, for a half hour, to pitch my services via phone to Trey Wright of executive search firm Kaye/Bassman International. The business is based in Plano, TX.
Wright's special expertise is higher education. That sales call was to be from 11:30 AM to noon New York Time.
For that, I prepared 3.4 hours. I bill at $80 per hour.
The meeting never happened. Wright did not call. He did not return my call. He did not transmit an email explaining why.
On my phone call to Wright, after he didn't call me, I observed that he might have re-thought my usefulness to his organization.
However, the work still had been done. The law should require payment for that research on leadership trends in the higher education segment and how Kaye/Bassman could add value.
On May 31st, I posted on this blog and other digital platforms about my perception of extreme disrespect. What I felt might have been what Willy Loman experienced in "Death of a Salesman." Here is that post.
I emailed a copy of the post to co-chief executive officer of Kaye/Bassman Jeff Kay. I have received no response, at least not yet. Also, there has been no response from Wright.
I had also requested legislation be introduced in the U.S. Senate that would compensate businesspeople like myself for sales pitches which were officially scheduled for delivery and the prospects did not comply with the agreement.
A faster way to sort this out and even get paid, though, could be the small claims court route. That can be efficiently handled pro se. In a New Jersey court I had argued my case and won it.
In my filing, I would enclose this invoice Download INVOICEKayeBassmanInternational
The American brand of capitalism is built on the assumption of fair dealings between sellers and prospective buyers. An appointment is made for a sales presentation. The vendor prepares comprehensively so as not to waste the prospect's time. Then the process moves on to a close or not-at-this-time.
It is well known in American business that prospects can learn the most from vendors. That's why sales calls are so valued. And vendors treated with respect. Usually.
Simultaneously, those doing the presentations learn from each one. That's why rejection is never failure. Instead it represents progress on the learning curve. From my negative experience with Kaye/Bassman I learned this: Insist on respect. And do it the American Way - that is, by seeking assistance through the U.S. system of law.
Wright and his organization - Kaye/Bassman International - could have learned from the research I had performed and the recommendations I had developed. They missed out. So, did their client, both employers and job applicants. Perhaps those two constituencies should file class action lawsuits about being denied the data and insight I could have brought to the job search process. After all, as McKinsey hammered, there is a war for talent going on.
