Points of law have a way of intersecting with public policy. One has to wonder if the oil spill will become embedded in the memory bank of the California Supreme Court Justices as they review the use of contingency in public nuisance cases, that is, those filed by government entities.
These are not the best of times to be a business accused of creating or contributing to a public nuisance.
