For couples who do use sex toys, the first question is a branding one: Would you purchase your next toy from Philips? That company's image is more associated with electronics than erogenous zones. Yet, Philips has entered the adult-pleasure market with, reports Cliff Kuang in FAST COMPANY, three sex toys it designed for couples. The devices purr, heat up, and are suited to both genders.
The second and legal-oriented question: Would you file a product-liability lawsuit, based on defective design, if the device causes personal injury? Would someone else file the lawsuit if your introduction of the device harmed them? Did you view the labeling as not adequately warning you about what constitutes possible misuse and the consequences of that? Those can turn out to be weighty legal issues. Remember the historic "Clancy" case, at the heart of the California Supreme Court review of contingency, started out in an adult book store Download H031540.
Kaung explains, Philips claims "the design is meant to bring a new level of ergonomics to sex toys ... people can easily add them to their usual contortions." That's the rub. Suppose the addition of the device results in a user wrenching a back, falling out of bed, or becoming overly aggressive which contributes to physical or emotional injury of the partner? Will the labeling be determined to be adequate to caution about what could occur if there is "misuse?"
Admittedly, a defective design lawsuit can be difficult to win. Think "Godoy," a personal injury lead paint case which the Wisconsin Supreme Court dismissed on the design claim. However, the "Godoy" plaintiff could still sue on failure-to-warn. So, there, Philips. Better make a list and check it twice of what could be too naughty and only nice with device use.
Perhaps Jones Day partner Mark Herrmann, co-author of blog Drug and Device Law, could help us out with this one.

well this can be a new innovations for them expanding there horizon in the adult industry, even-though that they are well known in electronics industry these does not mean it would be easy as pie for them to succeed.

I don't think so if Philips sex toys can give a good quality like other known sex toys store.

It would be interesting to see how other well known brands perform in the adult market. Whether the products would be good enough and whether the brand could transfer successfully into this market is a tough question.

You think sex toys from Phillips would be quality since they have been manufacturing electronics for so long. Sex toys should be easy for them!

It is totally wrong for a health care company such as Philips to assume that they will automatically have success in the sex toys industry. I cant believe they have been so naive.
