RI SC - Official Plaintiff Notice of Counsel and Issues

More details about the Rhode Island Supreme Court oral arguments re lead paint public nuisance litigation on May 15.  The plaintiff, that is, the state of RI notified the RI Supreme re the names of the presenters and the issues.  [Here is a copy of that document which can be retrieved free Download NoticeofCounsel.pdf ].

The state divides the issues into five tracks.  Here are those tracks and the presenters in each category:

• Track One - Liability.  And that is divided into three parts.  The first is public nuisance, with Fidelma Fitzpatrick [30 minutes].  The second is causation, with John J. McConnell [15].  The third is separation of powers - legislative deference, constitutional, and trial errors, with Assistant Attorney General  Neil F.X. Kelly [15].

• Track Two - Compensatory Damages. Arguments by Special Assistant Attorney General Allaire-Johnson.

• Track Three - Atlantic Richfield Successorship Liability.  Arguments by John J. McConnell.

• Track Four - Contempt.  Arguments by Assistant Attorney General James R. Lee.

• Track Five - Contingent Fee Agreement. Arguments by Assistant Attorney General Neil F.X. Kelly.
