Lousy Places to Get Sued

So far, since we haven't seen any action in California, Rhode Island seems the worst place for a corporation to get sued for lead paint.  After all, the RI defendants Sherwin-Williams, NL Industries, Millennium Holdings won "Thomas" in Wisconsin and NL won "City of Milwaukee," also in Wisconsin.

But, other locales carry their own horror stories.  In Overlawyered.com, Walter Olson reports on a FORBES article he contributed to on the worst places to get sued in certain categories.  They include:

  • LA - ADA
  • Miami - Medical Malpractice
  • Starr County, Texas - Personal Injury
  • Cook County, Illinois - Product Liability
  • West Virginia - Environmental.

Reflection:  Will RI prove so bad for lead paint public nuisance litigation that the high court, which is hearing the appeal May 15th, will not overturn the trial-court verdict or grant a new trial?  If so, then the defendants will have to move the case to federal jurisdiction on constitutional grounds.
