A sleeper during the Eliot Spitzer Administration was his efforts to lead in reform of medical malpractice in New York. His aggressive posturing as the steamroller masked the complexity of his mixed-bag agenda. One of his priorities, Spitzer told medical doctors on March 5th, was to present proposals to the New York Legislature.
Now, tort reformers, notes Waler Olson in Point of Law, realize that they have lost a key ally. Among those grieving is the National Association of Manufacturers [NAM]. On its blog, the NAM's Carter Wood recounts how in 2007, Spitzer established a task force to figure out how to break the back of the gigantic annual increases in medical malpractice premiums. In 2007, that rise was 14 percent.
