During the last few days plenty has been happening in "Thomas."
To begin with, only one count is left on the table. All the other counts in "Thomas" have been tossed. That count is: Failure to warn.
Next, the plaintiff has to include all points it wishes to make in its closing statement. It can't introduce any of those fresh in rebuttal. That is viewed as a major blow to the plaintiff.
Closing arguments will begin Wednesday morning and are expected to continue into Thursday. The jury is expected to get the case then. In Wisconsin, only 6 out of the 12 jurors have to agree in order to have a verdict.
